Fieldex Sdn. Bhd. (“FieldEx” ) owns and operates the website, https://www.fieldex.com/, including any subdomains (the “Website”) and the FieldEx web and mobile application (the “App”), (together “FieldEx Services”).  

FieldEx, together with its affiliated companies under the FieldEx group of companies (collectively “we”/”us”/”our”), is committed to protecting the personal data which may be collected, used, and processed in the course of providing you with the FieldEx Services. To ensure that you are able to make informed decisions about your personal information, we provide you with this Privacy Notice describing how we collect, store, use and process personal data information through the FieldEx Services. 

By providing your personal data to us, you are agreeing to the provisions of this Privacy Notice and the processing of your personal data as described in this Privacy Notice. 

1. Defining Personal Data

Personal data refers to any identifiable information that relates directly or indirectly to you and includes sensitive personal data. FieldEx Services is provided to business customers who have registered for an account with us (“Account Owners”) and any information that may be collected including personal data via the Account Owners’ use of FieldEx Services from or relating to the Account Owners’ employees, customers and contractors (collectively “End Users”) will be governed by the Account Owners’ own privacy policy. Insofar as such personal data is concerned, our role is merely a data processor and the processing of personal data is undertaken under instruction of the Account Owner as data user and solely for the purposes of any engagement by the Customer.Notwithstanding the above, this Privacy Notice may still apply to you if you interact directly with us in any way, such as by contacting us about the FieldEx Services.  

2. Scope of this Privacy Notice 

This Privacy Notice applies to all activities which we undertake in the course of providing and/or operating the FieldEx Services. This Privacy Notice will not, however, apply to third-parties activities that we do not own or control, including that of Account Owners and third-parties that offer products or services to Account Owners, linked or made available through the FieldEx Services. In the event any End User or any other personal data is made available to us by the Account Owners, the Account Owners as data users are responsible for ensuring that they have obtained the necessary authorizations and consents from the End User data subjects to disclose the personal data to us in compliance with any applicable data protection laws. 
In particular, Account Owners represent and warrant to us that:

1. it has complied with the applicable data protection laws;
2. it has the necessary consents (including where applicable, explicit consent) from each End User identified in the personal data to disclose the personal data to a third party such as FieldEx for use in the manner as set out in this Privacy Notice; and
3. it shall not do anything that may cause us to be in breach of any applicable data protection laws.
   
   

3. Types Of Personal Data We Collect

1. Personal Information
   
   1. your name, email address, business address, phone number and other information about yourself that may identify your person;
   2. your credit or debit card information, bank account details and payment history;
   3. your personal interests and preferences;

2. Social Media / Marketing Data
   
   1. information about any transactions, both free and paid, that you enter on the Website(s);
   2. information about you that is available on the internet, such as from Facebook, LinkedIn, Twitter and Google;
   3. publicly available information that we acquire from third party service providers.

   1. information about your device and your visits to the Website such as your IP address, geographical location, browser type, referral source, length of visit, and pages viewed;

   1. any of the above personal data from third party applications which you have instructed us to link to the FieldEx Services and/or which you have consented for us to collect from;

6. We do not collect Sensitive Information from you.

You are free to explore our Website, landing pages and microsites without providing any personal information about yourself. However, when you register for or use the App or try to download any relevant content, we may request that you provide personal information about yourself. This information is used by us to provide general statistics regarding use of the FieldEx Services. For this purpose, we link automatically collected data such as navigational data and log files to personal information. We do this to improve the FieldEx Services we offer you and improve our marketing, analytics and site functionality.Provided you give us your consent, we may send you emails about our current products, new products, and other updates related to the FieldEx Services. 

4. How We Use the Personal Data We Collect

1. We may process your personal data for one or more of the following purposes - 
   
   1. verification of your identity in relation to accessing the Website or App;
   2. enable you to be provided with the FieldEx Services;
   3. facilitate, assess or process any request made by you in the provision of the FieldEx Services;

2. Use of Navigational Information

In addition to the purposes listed above and specifically in respect of Navigational Information, we may use the same to enable task scheduling by the Management Users and Admin Users within the Account by accessing the location data of users in real-time and to optimise all other navigation related features within the App.

3. Customer Testimonials & Comments

We post customer testimonials and comments on our Website(s), which may contain personal information. We obtain each customer's consent via email prior to posting the customer's name and testimonial.

4. Any other purpose

We will seek your consent in the event our use or processing of your personal data falls outside the purposes identified above. We will never sell your personal data to any third party.

5. Disclosure of Your Personal Data

We may disclose your personal data to the following third parties:-

6. Security & Location of Your Personal Data

We use a variety of security and encryption technologies to protect your personal data from unauthorised access, use or disclosure. We have policies in place to ensure that all data including personal data is secured and handled using appropriate physical, technical and organisational measures.
We may store or transfer your personal data to places outside Malaysia including where our service providers, cloud partners, outsourced data storage or data processing services are located outside Malaysia or have servers outside Malaysia. You consent to us transferring your personal data to places outside Malaysia in these instances.

‍We retain any personal data that you provide to us where we have an ongoing legitimate business need to do so (for example, as long as is required to continue providing the FieldEx Services to you, to contact you about our products and services, or as needed to comply with our legal obligations, resolve disputes and enforce our agreements).If you have elected to receive marketing communications from us, we retain information about your marketing preferences for a reasonable period from the date you last expressed interest in our content, products, or the FieldEx Services, such as when you last opened an email from us or ceased using your FieldEx account. We retain information derived from cookies and other tracking technologies for a reasonable period from the date such information was created.

You may have subscribed to our marketing communications and supplied your personal data when using our Website or App. If you change your mind, you may unsubscribe by clicking on the "unsubscribe" link located on the bottom of our emails, updating your communication preferences, or by sending an email to privacy@fieldex.com. Customers cannot opt out of receiving transactional or product update emails related to their account with us or for the usage of the FieldEx Services.Our marketing team utilises display advertising on our Website and other sites. We use cookies and web beacons to collect information about your activities on these advertisements to provide you targeted advertising based on your interests.  If you wish to not have this information used for the purpose of serving you targeted ads, you may opt-out by writing to us at privacy@fieldex.com. Please note this does not apply to generic advertisements.Cookies and similar tracking technologies are used by us to track content usage and traffic on the Website and App. A cookie is a text file that is downloaded on your hard disk by a web server when you visit certain websites. Cookies and similar tracking technology help us compile aggregate statistics about usage of the Website and App, such as how many users visit the Website, how long users spend viewing the Website, and what pages are viewed most often. We reserve the right to amend this Privacy Notice from time to time.  Unless stated otherwise, our current Privacy Notice applies to all personal data that we have about you. The date on which the latest update was made is indicated at the top of this document. Your continued use of the Website and/or App signifies your acceptance of any changes. If you do not agree to any changes after receiving a notice of such changes or otherwise do not agree with this Privacy Notice, you shall stop using the Website and/or the App. You are encouraged to consult this Privacy Notice regularly for any changes.
2. Assignment of FieldEx. If FieldEx (or FieldEx’s assets) is acquired by another company, whether by merger, acquisition, insolvency or otherwise, that company would receive all information gathered by FieldEx on the Website and/or App. In such an event, you will be notified via email and/or a prominent notice on our website, of any change in ownership, uses of your personal data, and choices you may have regarding your personal data.
